Terminology

Lessor: Zaox Construction Machinery A.S.

Lessee: The individual or entity renting the machinery.

Pickup Day and Return Day: The Pickup Day and Return Day are not counted as Rental Days, and no rental charges apply for these days.

Rental Days: Rental Days are the days between the Pickup Day and Return Day, used exclusively for calculating rental fees.

Rental Period: The period for which the Lessee has paid to rent the machinery.

Pickup: Pickups are available on the designated Pickup Day between 12:00 and 15:30 PM. The Pickup Day is not considered a Rental Day.

Return: Returns are accepte on the designated Return Day between 8:00 AM and 11:00 AM. The Return Day is not considered a Rental Day.

Late Returns: If the machinery is returned after 11:00 AM on the Return Day, that day will be charged as a Rental Day.

Free Sundays and National Holidays: Sundays are free of charge when included with at least two consecutive Rental Days. National holidays are free of charge.

Saturday: Returns are permitted on Saturdays, but pickups are not available.

General

Usage Limit

The rental is based on a maximum of 8 hours of daily use. If the total hours exceed 8 hours per day multiplied by the number of Rental Days, the Lessee agrees to pay an additional fee equivalent to the daily rental rate divided by 8 for each extra hour.

Early Return

If the Lessee wishes to return the machinery before the designated Return Day, they must notify the Lessor in advance.

Rental Period Extension

IMPORTANT: To extend the Rental Period, the Lessee must notify the Lessor at least 48 hours before the original Rental Period ends. Payment for the extended period must be made before the original period concludes.

Liability

WARNING: The Lessee assumes full responsibility for any damage or harm (including those caused by manufacturing or assembly defects) to persons or property resulting from the use of the equipment until its return, as per the contract terms.

Equipment Restrictions

The leased equipment may not be subject to any pledge, lien, or encumbrance by the Lessee. The Lessee must promptly notify the Lessor, both informally and via registered letter, of any act or event that may jeopardize the Lessor's rights over the equipment.

Subleasing Prohibition

PROHIBITED: The Lessee is strictly prohibited from subleasing the equipment or transferring the contract to third parties.

Fuel Condition for Rental Agreement

FUEL REQUIREMENT: The rented machine(s) will be provided to the Lessee with a full tank of fuel at the start of the rental period. The Lessee is required to return the machine(s) with a full tank of fuel at the end of the rental period. If the machine(s) are returned with less than a full tank, the Lessee will be charged for the cost of the missing fuel, calculated at the current market rate per liter, plus an administrative fee of 500,00 CZK. The total charge will be added to the final invoice.

Delivery and Return Reports

Delivery Report

Upon pickup or delivery, the Lessee must sign a Delivery Report provided by the Lessor, which includes:

• A detailed description of the equipment (e.g., make, model, serial number, and attachments)
• The condition of the equipment, noting any pre-existing damage or issues
• The recorded hours of use (based on the equipment's hour meter) at the start of the Rental Period
• The fuel level at the time of pickup or delivery
• The date and time of pickup or delivery
• Any additional accessories or components provided (e.g., buckets, augers)

By signing the Delivery Report, the Lessee confirms agreement with the documented condition, hours, and details of the equipment at the start of the Rental Period.

Return Report

Upon return, the Lessee must sign a Return Report provided by the Lessor, which includes:

• A detailed description of the equipment (matching the Delivery Report)
• The condition of the equipment, including any damage or issues observed during the return inspection
• The recorded hours of use at the end of the Rental Period
• The fuel level at the time of return
• The date and time of return
• Any additional notes regarding cleaning, repairs, or other charges

IMPORTANT: By signing the Return Report, the Lessee confirms agreement with the documented condition, hours, and details of the equipment at the end of the Rental Period. Any disputes must be noted in writing at the time of signing; otherwise, the report's accuracy is deemed accepted.

Identification

At the time of equipment delivery or pickup, the Lessee must present valid government-issued photo identification (e.g., driver's license or passport). The Lessor may retain a copy or photograph of the identification for record-keeping, in compliance with applicable privacy laws.

Rental Agreement

Upon picking up the machinery, the Lessee must sign a Rental Agreement that incorporates and is governed by these Terms and Conditions.

Payment Terms

Short-Term Rental (60 Days or Less)

Payment must be made via bank transfer to account XXXX/XXXX, using the variable symbol noted in the proforma invoice. A tax invoice will be issued at the end of the Rental Period.

Long-Term Rental (More Than 60 Days)

Payment terms for long-term rentals are agreed upon on a case-by-case basis.

Machinery Damage

Covered by Warranty

All machinery is covered by the Lessor's warranty for issues or breakages not caused by improper use, lack of regular inspections, or inadequate maintenance. The coverage amount is specified on the product page and proforma invoice.

Not Covered by Warranty

• Engine failure due to dust or debris accumulation
• Engine seizure from inadequate maintenance or inspection (e.g., uncleaned air filter, use of low-quality or contaminated fuel, or water in the fuel tank)
• Damage from overloading, repeated improper or careless handling, or neglected maintenance and inspections
• Non-removable stains or contamination from concrete, paint, or other substances
• Damage to the machine's interior components
• Damage to pins due to insufficient or absent lubrication
• Vehicle overturning caused by operator inexperience or excessive risk-taking

Machinery Failure

In the event of a component breakdown, the Lessee must immediately notify the Lessor. The Lessor will:

• Replace the machine as soon as reasonably possible, or
• Arrange for immediate repair or transport the machine to its headquarters

If a replacement machine is unavailable and downtime is prolonged, the Lessor will reimburse the Lessee for the days the machine is out of service.

Theft

EMERGENCY PROCEDURE: In case of theft, the Lessee must immediately notify the Lessor and file a police report. A notarized copy of the report must be delivered to the Lessor within 24 hours.

Fire

If a fire occurs during use, the Lessee must act promptly, using the provided fire extinguisher if possible, and notify the Lessor immediately. For fires occurring when the machinery is unattended, the Lessee must inform the Lessor immediately and file a police report. A notarized copy of the report must be delivered to the Lessor within 24 hours.

Location Notification Requirement

The Lessee agrees to inform the Lessor of the current location of the rented machinery at all times during the rental period. The Lessee shall:

• Provide immediate written notice (email or SMS to +420 774 04 7755) of any change in the machine's operating location
• Notify ZAOX within 24 hours if the machine is moved to a different worksite
• Provide GPS coordinates or detailed address information upon request
